Welcome to Grace & Gabrielle. These Terms of Service apply whenever you browse graceandgabrielle.com or place an order with us. By using our website, you agree to these terms. Please read them together with our Shipping Policy, Return & Refund Policy and Privacy Policy.

1. Who we are

Grace & Gabrielle is an online women's fashion store operated by Grace and Gabrielle. Our business address is available on request; just email us at info@graceandgabrielle.com. In these terms, "we", "us" and "our" refer to Grace and Gabrielle, and "you" refers to anyone using our website or buying from us.

2. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where a term would do so, it applies only to the extent the law allows.

3. Products, sizing and colours

We take care to describe and photograph our products accurately. Colours can look slightly different depending on your screen, and measurements may vary a little from style to style. Please check the size guide on each product page before ordering. If you are unsure, our team is happy to help.

4. Prices

All prices are shown in Australian dollars (AUD) and include GST. Shipping within Australia is free. We may change prices at any time, but changes won't affect orders we have already confirmed. If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund you in full.

5. Orders

When you place an order, you are making an offer to buy the products in your cart. We accept your offer when we send you an order confirmation email. We may decline or cancel an order, for example when a product is out of stock, when we cannot verify your payment, or when we suspect fraud. If we cancel an order, we will refund any amount you have paid.

6. Payment

Payment is taken at checkout. The payment methods we accept are listed on our Payment Options page. All payments are processed securely; we never see or store your full card details.

7. Shipping, returns and refunds

Delivery is covered in our Shipping Policy. Change-of-mind returns and your rights for faulty or incorrect items are covered in our Return & Refund Policy.

8. Discounts and promotions

Discount codes and promotions apply only during the stated period and under the stated conditions. Unless we say otherwise, they cannot be exchanged for cash or combined with other offers. Multibuy discounts are calculated automatically at checkout.

9. Using our website

You agree not to misuse our website, for example by trying to gain unauthorised access, interfering with its operation or using it for unlawful purposes. All content on this website, including text, photos, graphics and logos, belongs to us or our licensors and may not be copied or reused without our written permission.

10. Liability

To the extent permitted by law, and subject to section 2, we are not liable for indirect or consequential loss arising from your use of our website or products. Where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited to replacing or repairing the goods, or refunding the price you paid.

11. Privacy

We handle your personal information in line with our Privacy Policy.

12. Changes to these terms

We may update these terms from time to time. The version shown on our website when you place your order applies to that order.

13. Governing law

These terms are governed by the laws of the Netherlands, and the courts of the Netherlands have non-exclusive jurisdiction. This does not take away the protection you have under the consumer laws of the country where you live, including the Australian Consumer Law.
